General.  Except as otherwise provided in a written agreement signed by Mile51 Media, LLC, these Terms of Use represent the entire understanding between you and Mile 51 Media, LLC and our affiliates including Passion for Savings (collectively, “Passion for Savings”) regarding your use of www.passionforsavings.com (the “Site”) and your submission of any materials to us. Your access to the Site subject to these Terms of Use and the passionforsavings.com Privacy Policy. By accessing the Site, you signify your acceptance of these Terms of Use and your acceptance of the Privacy Policy.

Passion for Savings reserves the right, at any time, to modify, alter, update, or remove portions of these Terms of Use or the Privacy Policy, so please check them from time to time as your continued use of the Site signifies your acceptance of any changed terms. If you are dissatisfied with these Terms of Use or the Privacy Policy, your sole and exclusive remedy is to discontinue your use of the Site.

Disclaimer.  Passion for Savings PROVIDES THE SITE AND ITS SERVICES ON AN “AS-IS” BASIS. Passion for Savings MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THOSE RELATED TO: (1) THE OPERATION OF THE SITE; (2) THE INFORMATION, CONTENT, MATERIALS, OR SERVICES INCLUDED OR DESCRIBED THEREIN; AND (3) ANY APPLICATION, INFORMATION, OR REQUEST SUBMITTED TO US THROUGH THE SITE. Definitions.  The following are definitions used thought the Terms of Use, Privacy Policy, Site Disclosures, and the Giveaway Rules:

Affiliate – a company, who has for the purpose of advertizing and marketing to Readers of the Site, has provided compensation to the Site, Prizes, or other monetary item for the purpose of promoting a product or service.

Author – Posts contained within the Site are written and edited by Heather Schisler unless otherwise noted.

Comment – the original and un-copyrighted thoughts, views, or information expressed by a Reader concerning the Post to which the comment is attached.

Email – a good, working, and active electronic mail address provided by the Reader when leaving a Comment within the Giveaway post, and the inbox for such an email will allow any and all emails from any email with a @passionforsavings.com address.

Giveaway –the offering of a product, service, or item for free to a person who qualifies according to the terms of the Site and rules of the Giveaway.

Reader – a human person who visits and reads passionforsavings(dot)com and leaves a comment on a Giveaway post.

Post – an individual posting of information by one or more Author which contains unique information different from other posts contained within the Site.

Prize – is provided by the Site or an Affiliate or Affiliates depending on the prize, for which compensation may or may not have been paid to the Site.

Site – is the weblog or blog known and operated under the service mark “Passion for Savings” and its domain name passionforsavings.com owned by mile51 media, LLC.

Winner – is a Reader who has been selected by use of a random drawing and who has been selected as the Reader who should receive the Prize associated with the Giveaway.

Limitation of Liability.  IN NO EVENT SHALL Passion for Savings BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOSS OF USE, BUSINESS INTERUPTION, OR LOSS OF DATA, ARISING OUT OF OR RELATING TO THE SITE, THE INFORMATION, CONTENT, OR MATERIALS DESCRIBED THEREIN, THE OPERATION OF THE SITE, ANY APPLICATION, INFORMATION, OR REQUEST SUBMITTED TO US THROUGH THE SITE, AND/OR THE SERVICES DESCRIBED THEREIN, EVEN IF Passion for Savings IS EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Passion for Savings’ LIABILITY TO YOU OR ANY THIRD PARTY IN ANY CIRCUMSTANCE IS LIMITED TO A MAXIMUM OF $100.

Links.  The Site may contain links to other Web sites on the Internet that are owned and operated by someone other than Passion for Savings. Passion for Savings provides these links solely as a convenience. The appearance of a link does not imply Passion for Savings endorsement, nor is Passion for Savings responsible for the content of any linked site. You access linked sites at your own risk. Passion for Savings may derive some form of compensation from the redirection to the link, you waive any claim or right to this compensation by clicking on the link.

Eligibility.  You must be 18 years or older to use the Site.

Compliance with Laws.  You agree to comply with all applicable laws, statutes, ordinances, and regulations regarding your use of the Site and your use of the services described therein.

General Proprietary Rights.  The Site is owned by Mile51 Media, LLC and contains material that is derived in whole or in part from Passion for Savings and other sources. The Site and its contents are protected by international copyright, trademark, service mark, and other intellectual property laws. You may not modify, copy, reproduce, republish, upload, post, transmit or distribute in any way any material from the Site, including without limitation code or software, without Mile51 Media, LLC’s express written permission.

Comments.  All Comments become the property of the site, and may be used without any further permission or request of the Reader.

Warranty and Claims.  Any product claim, statistic, quote or other representation about a product or service should be verified with the manufacturer, provider, or party in question. This site makes no representations or warranties about any Item contained within any Post on the Site.

Trademarks and Service Marks.  Trademarks and Service Marks including but not limited to, “Passion for Savings,” “NWA Deals” “Mile51 Media” and their respective logos, are Trademarks or Service Marks of Mile 51 Media, LLC and/or its affiliates. They may not be used in connection with any product or service other than those services offered by Mile51 Media, LLC or its affiliates, in any manner that is likely to cause confusion, or in any manner that disparages or discredits Passion for Savings. or its affiliates. All other trademarks are the property of their respective owners.

Applicable Law.  Mile51 Media, LLC operates the Site from Springdale, Arkasnas, United States of America. The laws applicable to the interpretation of these Terms of Use shall be the laws of the State of Arkansas without reference to its conflict of law provisions.

Disputes.  You agree that any action at law or in equity arising out of or relating to these Terms of Use, the Site, and/or the services described therein shall be filed exclusively in the state or federal courts of Washington County, Arkansas, USA, and you hereby consent and submit to the exclusive jurisdiction and venue of such courts. No action arising under or relating to these Terms of Use may be brought by either party more than one year after the cause of action has accrued.

Termination.  These Terms of Use shall remain in force until terminated by Passion for Savings and Mile51 Media, LLC. Passion for Savings and Mile51 Media, LLC may terminate the Terms of Use, or suspend your access to all or part of the Site, without notice, for any conduct that, in their sole discretion, believes is disruptive or is in violation of any applicable law or these Terms of Use. In the event of any such termination, the provisions regarding disclaimers, limitations of liabilities, Submissions, intellectual property rights, choice of law, and venue set forth in these Terms of Use shall survive.

Miscellaneous.  If any provision of these Terms of Use shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

Site Disclosures:

Affiliates.  This blog uses affiliate links within post content, any post containing an affiliate link contains the word “Affiliate(s)” within the post.  The use of Affiliate(s) links helps to support the time and energy that I put into making this site a great resource!

Standards.  This Site, its Author(s) abide by word of mouth marketing standards, and believe in honesty of relationship, opinion and identity.

Content.  The views and opinions expressed on the Site are only that of the Author. Product Reviews are never paid, and are always an honest opinion; however, samples may be provided for review, but the Author retains full editorial rights and always states a personal opinion. Compensation.  This Site accepts forms of cash advertising, sponsorship, paid insertions, and other forms of compensation. The Site is compensated to provide opinion on products, services, websites, and various other topics; however, the Author always give an honest opinion, finding, belief, and experience on those topics or products regardless of compensation.

Giveaway Rules:

Unless otherwise specifically stated within the text of an individual Giveaway Post the following are the rules for each Giveaway held on the Site.

1. The Giveaway is subject to the Terms of Use and Privacy Policy of the Site.
2. Each Giveaway is open to all legal residents of the United States of America, who have attained the age of 18, or similar age required by the state law of the Reader’s domicile.
3. All Giveaway entries made by the Reader must be made by leaving a Comment in the Comments section of the Giveaway Post.  All entries attempted by any other means, including but not limited to: email, text, other social media sites, Affiliate sites, or any other means will not be accepted, counted, or considered and are deemed void upon receipt.
4. The Winner(s) will be randomly selected using a third-party, currently And the Winner Is Word Press PlugIn, using a private drawing; however, this third-party site is subject to change without notice.
5. Giveaway Winners will be posted to our Giveaway Winners Page.
6. A Reader who is a Winner of the Giveaway will be notified by Email and will have 48 hours from the outgoing email’s time/date stamp to respond to the same email from which the notification was sent before an alternate Winner is selected. Once an alternate Winner is selected, the initial Winner will not receive the Prize, has no recourse against the Site, but will be eligible to enter another Giveaway immediately.
7. Reader who is a Winner of the Giveaway may have their Email disclosed to an Affiliate as a condition to receiving the Prize.
8. Readers are eligible to win a Prize once every 30 days.
9. This Giveaway is void in any state where the terms of this Giveaway violate that states law; it is the Readers responsibility to insure that no state laws are being violated before they enter the Giveaway.

This Privacy Policy discloses the online privacy practices for Mile51 Media, LLC. and its affiliates including Passion for Savings (collectively, “Passion for Savings”) and applies to the information we collect through www.passionforsavings.com (the “Site”) and incorporates the Site’s Terms of Use. By accessing and/or using the Site, you are consenting to the collection, storage, and disclosure of data as described in this Privacy Policy.

Passion for Savings reserves the right, at any time, to modify, alter, update, or remove portions of this Privacy Policy. We will post any changes to this Policy on this page so you can readily review the most current version. We will alert you that changes have been made by indicating on the bottom of this Privacy Policy the date it was last updated.

Your IP Address.  An Internet Protocol (IP) address is a number that is automatically assigned to your computer every time you browse the Internet. When a user requests a page from the Site, our servers log the user’s current IP address. We use IP addresses to help diagnose problems with our servers and to administer the Site.

Cookies.  The Site is developed using Active Server Pages (ASP), and we use per-session “cookies” (pieces of data your browser stores in your computer’s memory at Passion for Savings’ request) to establish user sessions on our server. We use the cookies to carry information about usage from page to page through the Site. Passion for Savings does not use cookies to retrieve personal information about you from your computer.

Acceptance of Cookies.  Most browsers are set up to accept cookies, but you can usually change your browser settings to refuse them. If you disable cookies, your browser may experience some erratic behavior on some portions of the Site.

Disclosures to Third-Parties. Passion for Savings will not disclose your Submission Information to third parties, including, without limitation, Affiliates, advertisers, or marketing firms unless it is for the sole reason of disclosing Winner Email or physical address for shipment of a Prize.

Links.  This Privacy Policy applies only to information collected by Passion for Savings. Other Web sites (including those that we may link to) may have their own policies. Passion for Savings has no responsibility for or control over the information-collection practices of such third-party Web sites.
